Terms of Use

These Terms of Use (the "Terms") govern your access to and use of supersoils.com (the "Site") and your purchase of products and delivery services from Supersoils.com Inc., operating as Super Soils ("Super Soils", "we", "us"). By using the Site, creating an account, requesting a quote, or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. Ordering and acceptance

Placing an order through the Site (or accepting a quote we send you) is an offer to purchase. An order is accepted when we confirm it and payment is authorized or received. We may decline or cancel an order — including after confirmation — where a product is unavailable in your area, where the delivery address cannot be serviced safely, or where an obvious pricing or listing error has occurred; in any such case your payment for the affected items will be refunded in full.

2. Pricing, quotes and taxes

Product and delivery prices are calculated for your specific delivery address and are subject to change as material and delivery costs change — checkout always shows current pricing. A written quote from us locks its pricing for the validity period stated on the quote; after that period, current pricing applies. Applicable taxes (including HST) are calculated and shown at checkout. Where a deposit has been paid on a pre-order or reservation, it is credited against the final purchase at checkout.

3. Delivery address accuracy

Delivery pricing, product availability and scheduling are based on the delivery address and location you provide. You are responsible for the accuracy of that address and of your delivery instructions. If the address you provided is incorrect or incomplete, we may need to reprice, reschedule, or cancel the affected delivery, and additional charges can apply to a corrected address.

4. Bulk products and quantity estimates

Soil, aggregate, mulch and similar bulk products are natural materials sold by volume or weight. Colour, texture, moisture content and coverage vary naturally between loads, and quantities produced by our on-site calculators are estimates only. Reasonable variation in appearance or coverage is not a defect. If you have an issue with a delivery, contact us within 24 hours of delivery and we will make it right.

5. Deliveries

Deliveries are performed by Super Soils' network of independent supplier and hauling partners. Delivery dates are chosen at checkout and confirmed by us; a delivery date is a scheduled day, not a guaranteed time of day. The full delivery terms — including access requirements, placement of material, and what happens when a delivery cannot be completed — are set out in our Delivery & Cancellation Policy, which forms part of these Terms.

6. Cancellations, changes and refunds

Our cancellation windows, refund handling (including taxes) and rescheduling process are set out in the Delivery & Cancellation Policy. Refunds are issued to the original payment method.

7. Payment

We accept the payment methods offered at checkout, which may include credit card (processed by our payment processor), Interac e-Transfer, and emailed payment links. An order paid by invoice or e-Transfer may be held from scheduling until payment is received. Unpaid checkout sessions expire automatically and the associated order is released.

8. Accounts

You are responsible for the accuracy of the information on your account and for keeping your login credentials secure; activity under your account is your responsibility. Company (contractor) accounts may have multiple authorized users — the account owner is responsible for managing who has access. We may suspend accounts used in breach of these Terms.

9. Reviews and submitted content

If you submit a review, testimonial, photo or similar content, you grant Super Soils a non-exclusive, royalty-free licence to reproduce and display it (with your name and city as submitted) on the Site and in our marketing. We may moderate, edit for length, or decline to publish submissions. Do not submit content you do not have the right to share.

10. Acceptable use of the Site

You agree not to misuse the Site — including by attempting to interfere with its operation, scraping or bulk-extracting content or pricing without our written permission, submitting false orders or applications, or impersonating another person or business.

11. Intellectual property

The Site and its content — including text, product descriptions, images, logos and software — are owned by or licensed to Super Soils and are protected by law. You may not reproduce them for commercial purposes without our written permission.

12. Disclaimer and limitation of liability

The Site and its content are provided "as is". To the maximum extent permitted by applicable law, Super Soils' total liability arising from any order is limited to the amount you paid for that order, and we are not liable for indirect or consequential losses. Nothing in these Terms limits liability that cannot be limited under applicable law, including under Ontario consumer protection legislation, or excludes conditions and warranties that such law implies.

13. Communications

We send transactional messages about your quotes, orders and deliveries (confirmations, schedule changes, payment receipts, review requests). Marketing communications are sent only in accordance with Canada's Anti-Spam Legislation (CASL), and you may withdraw consent to marketing at any time using the unsubscribe mechanism in the message or by contacting us.

14. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario. You and Super Soils submit to the exclusive jurisdiction of the courts of Ontario, without limiting any mandatory consumer rights you hold in your province of residence.

15. Changes to these Terms

We may update these Terms from time to time; the version posted on the Site at the time you place an order applies to that order. Material changes will be indicated by the "Last updated" date above.
